This English translation is provided for convenience; the French version prevails. Version 1.2 of 15 October 2026.

This notice is published pursuant to French law no. 2004-575 of 21 June 2004 on confidence in the digital economy (LCEN), as amended by law no. 2024-449 of 21 May 2024 (SREN): provisions on the identification of the publisher and of the hosting provider, and article 19 (information owed by a provider of electronic commerce).

1. PUBLISHER

BusinessBrain is the trade name of the service published by BUSINESS BRAIN.

The BusinessBrain real-estate service, available at real-estate.mybusinessbrain.eu (portal) and api.real-estate.mybusinessbrain.eu (programming interface), is published by:

5. PUBLIC PROPERTY PAGES

A client agency may publish, by means of the service, the public page of a property. To locate the property, this page is limited to the town, the postcode and the neighbourhood; it never shows the street.

The agency is the publisher of that page: it determines its content and is answerable for it. It is responsible for including the statements that regulations require of it, in particular those of the French order (arrêté) of 10 January 2017 on consumer information by professionals involved in a real-estate transaction. It is also responsible for showing its identity on every public property page it publishes.

BUSINESS BRAIN is the hosting provider of these pages within the meaning of law no. 2004-575 of 21 June 2004; its details are given in § 1. These details are not yet displayed on every public property page; they will be by 31 December 2026 at the latest.

6. REPORTING ILLEGAL CONTENT

Anyone may report content hosted by BUSINESS BRAIN that they consider illegal, by e-mail to support@mybusinessbrain.eu (Regulation (EU) 2022/2065 on digital services, article 16). A “Report this content” link will be added to every public property page by 31 December 2026 at the latest; until then, reports are made by e-mail.

BUSINESS BRAIN acknowledges receipt without delay. A person examines the report in a diligent, objective and non-arbitrary manner. BUSINESS BRAIN then informs the author of its decision and of the available means of redress.

Knowingly presenting as illegal content that one knows to be lawful, in order to have it removed, is punishable by one year's imprisonment and a €15,000 fine (law no. 2004-575 of 21 June 2004, article 6).

The report states:

• the reasons why the content is illegal;
• the exact address (URL) of the page;
• the name and e-mail address of its author;
• a statement that the author believes in good faith that the information and allegations in the report are accurate and complete.

7. POINTS OF CONTACT (REGULATION (EU) 2022/2065, ARTICLES 11 AND 12)

The single point of contact is support@mybusinessbrain.eu, both for the authorities of the Member States, the European Commission and the European Board for Digital Services, and for the recipients of the service, users and visitors of the public pages alike. Recipients may also ask to be called back by a person on 06 64 46 46 79. No request is handled by an automated tool alone. Languages: French, English.

8. INTELLECTUAL PROPERTY

The service, its software, interfaces, texts, graphic elements and the BusinessBrain name belong to BUSINESS BRAIN or are licensed to it. Any reproduction, representation or adaptation, in whole or in part, without written authorisation is prohibited (articles L122-4 and L335-2 of the French Intellectual Property Code).

The content of public property pages belongs to the agencies that publish them.

9. PERSONAL DATA

Portal user accounts, billing, business prospecting by BUSINESS BRAIN, security logs: BUSINESS BRAIN is the controller. This processing is described in the Privacy Policy of BUSINESS BRAIN.

Data processed on behalf of an agency (principals, owners, buyers, visitors, correspondents): the agency is the controller; BUSINESS BRAIN is its processor. To exercise your rights over these data, contact the agency concerned first. BUSINESS BRAIN forwards to it any request it receives.

You have a right of access, rectification, erasure, restriction, objection and portability (articles 15 to 22 of the GDPR). For the processing carried out by BUSINESS BRAIN, write to support@mybusinessbrain.eu. The data protection lead is Rayane Caputo, President of BUSINESS BRAIN; no data protection officer has been designated. You may lodge a complaint with the French data protection authority (Commission nationale de l'informatique et des libertés, CNIL, www.cnil.fr).

10. COOKIES AND TRACKERS

The portal only sets the following trackers, which are strictly necessary for the service requested and therefore exempt from consent (article 82 of French law no. 78-17 of 6 January 1978). No consent banner is displayed.

• Session cookie (Auth.js): keeps the user signed in; set at sign-in.
• Cookie protecting against request forgery (Auth.js): secures sign-in; set at sign-in.
• authjs.callback-url: brings the user back to the requested page after sign-in; set at sign-in.
• NEXT_LOCALE: remembers the interface language; set only if the user chooses a language.
• Display preference: remembers the light or dark theme; kept in the browser's local storage.
• __stripe_mid, __stripe_sid (Stripe): fight payment fraud; set only on the billing page.

11. ARTIFICIAL INTELLIGENCE

The service includes an artificial intelligence assistant. Every e-mail written by this assistant for an agency carries a statement that says so (Regulation (EU) 2024/1689, article 50).

By default, the assistant uses the models of Mistral AI, a French company, which processes data in the European Union. The assistant's web search also goes through Mistral AI; the underlying search engine has not yet been identified. An agency may choose in writing the models of Anthropic, an American company. In that case, and for that agency only, data are transferred to the United States. This transfer is governed by the European Commission's standard contractual clauses; it remains subject to US law.
